Real Estate and Town Planning


As of 1956 the first Urban Law was announce publicly, clearly adopting the French conduct towards urbanism, a blend of law and order and court sentences have shaped what we know today as our complex urban world.

A very complicated field, were a wide range of professions come together such as Architecture, Law, Economics and Sociology, amongst others, requiring professionals of such areas and group effort to create tools to guide our urban cities, such as the GENERAL URBAN DEVELOPMENT PLAN (PGOU).

We have all heard about them, but few of us know that the PGOU must comply with a series of norms such as:

- Subject to the public, and given the position of a public function they must overlook urban matters (we all have a right to participate, whether we own or not property)

- Fair distribution of the benefits and what the burden planning could create amongst the citizens. (nobody should come out more benefited than someone else only because the person in charge for example decides to do the drawing of plans)

- They must comply with the Laws and superior urban tools, such as Territorial Plans.

- Must be viable (it is to say, it should be foreseen that the cost to urbanize does not exceed the cost of the benefits that the proprietor might obtain subsequently).

Proprietors of land, promoters, constructors, communities, neighbouring associations, ecologists associations or any other citizen has a right to speak and be heard in the urban elaboration process in their city. If it were not that way, there is the option of going to court to defend your rights, when it's understood that they will come of losing after the definitive approval.

At the moment, in the Costa del Sol area the following groups come together organized by hierarchy, and each subject to their superiors.

-PGOU for the corresponding municipalities

-Territorial Land Management for the Costa del Sol

-Territorial Land Management for Andalucia

-Andalucia Land Law

-Land Law

-Spanish Constitution

It is really quite complicated for citizen with no experience in these matters to find their way easily.
